1. Acceptance of these Terms

These Terms of Service and Risk Disclosure ("Terms") are a binding agreement between you ("you", "Customer") and Jose Rodolfo Esapa, an individual operating in Ghana and trading as "Alkebot" ("Alkebot", "we", "us"). Alkebot is an independent, individually-operated software project - it is not a registered company, bank, brokerage, or financial institution. By creating an account, verifying your phone number, subscribing to a plan, or downloading and running the Alkebot software, you confirm you have read, understood, and agree to be bound by these Terms and by our risk disclosures below. If you do not agree, do not create an account and do not use the service.

2. What Alkebot is - and is not

Alkebot is a piece of algorithmic-trading software (an "Expert Advisor") that runs inside the MetaTrader 5 platform on an account you control, applying a rules-based trading methodology - session timing, structured entry logic, position sizing, and configurable risk guardrails - that you configure and authorize.

Alkebot is not:

• a broker, custodian, or money manager - we never hold, transmit, or have access to your trading funds;
• a financial advisor, and nothing we publish, display in your dashboard, or say through our support channels (including any automated assistant) is personalized investment advice or a recommendation to trade;
• affiliated with, sponsored by, or endorsed by MetaQuotes, any broker, or any proprietary trading firm named on our site (including FTMO, Atlas Funded, FundedNext, or Exness). All trademarks belong to their respective owners.

3. Risk Disclosure - read this carefully

Trading foreign exchange, CFDs, and other leveraged instruments carries a substantial risk of loss and is not suitable for every investor. You could lose some, most, or all of the capital you allocate to a trading account running Alkebot. Only trade with capital you can afford to lose in full.

We do not guarantee profit, a particular win rate, or that any account will avoid a loss - in any period, on any account, under any market condition. Alkebot's rules are built around a methodology that has been profitable across the historical and live periods we present on our site, and we are transparent that this is real, not simulated, performance where we say so. That said:

• markets change. Volatility, liquidity, spreads, broker execution, and macroeconomic conditions shift over time, and a methodology that performed well historically or is performing well today can underperform, stop working, or produce losses in the future - including immediately after you subscribe;
• past performance, backtested or live, is not and never should be treated as a promise, guarantee, or reliable indicator of future results;
• backtested (Strategy Tester) results have inherent limitations - they are simulated with the benefit of hindsight, may not reflect real slippage, requotes, liquidity, or broker-specific execution, and can differ materially from live trading;
• any figures we show you - net profit, profit factor, win rate, drawdown, or account balances, whether on our public pages, in your dashboard, or through our chat assistant - describe specific historical periods and specific accounts. They are not a forecast and do not predict what any account, including yours, will do next;
• technology can fail. Internet outages, terminal crashes, broker downtime, or a VPS going offline can prevent Alkebot from managing open positions as intended.

You are solely responsible for every trading decision made on your account, for choosing your own risk settings, for the account and broker you connect, and for complying with the laws and regulations that apply to you in your own country.

4. Eligibility & your account

You must be at least 18 years old (or the age of majority where you live, if higher) and legally able to enter into this agreement to use Alkebot. Trading via automated software may be restricted or prohibited in some jurisdictions and by some brokers or proprietary trading firms - it is your responsibility to confirm this is permitted for you before connecting an account.

Accounts are created automatically once you verify a mobile number by SMS one-time code. You are responsible for keeping that number and your connected devices secure, for all activity under your account, and for notifying us promptly of any unauthorized use.

5. Subscriptions, billing & refunds

Access to Alkebot is sold on a recurring subscription basis. Plans, pricing, and the number of MT5 accounts each plan authorizes are shown at checkout before you pay. Subscriptions renew automatically until cancelled; you can cancel at any time from your dashboard, and cancellation takes effect at the end of the current billing period unless stated otherwise at checkout. Except where required by law or expressly stated at the time of purchase, subscription fees are non-refundable, including for periods where you chose not to run the software, ran it at a loss, or a connected account was suspended for breaching these Terms.

6. License, and what you agree not to do

We grant you a limited, revocable, non-exclusive, non-transferable license to install and run the Alkebot terminal software on MT5 accounts authorized under your active subscription, for your own trading only. You agree not to:

• reverse engineer, decompile, or attempt to extract the trading logic, entry/exit rules, or parameters underlying Alkebot;
• copy, resell, sublicense, rent, or redistribute the software, your license key, or your account access to any third party;
• use Alkebot to manage funds on behalf of other people or entities without our prior written agreement;
• circumvent account-bound activation, terminal key limits, or subscription enforcement built into the software.

We may suspend a terminal, revoke an activation key, or terminate an account that breaches this section, in addition to any other remedy available to us.

7. Suspension & termination

We may suspend or terminate your access if you breach these Terms, misuse the support or chat channels, engage in chargeback fraud, or where we reasonably believe your use creates legal, security, or financial risk to us or to other customers. Where an account is restricted for review, we aim to give you a reasonable notice period and a channel to resolve it through support before final action, except where immediate suspension is necessary (for example, suspected fraud or a security incident).

8. Limitation of liability

The Alkebot software, website, dashboard, and chat assistant are provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, Jose Rodolfo Esapa is not liable for any trading losses, lost profits, lost opportunity, loss of data, or indirect, incidental, special, punitive, or consequential damages arising from your use of the software, reliance on any figures published or communicated (including through the chat assistant), broker or third-party platform failures, market conditions, or events outside reasonable control (including internet, power, or hosting outages).

Where liability cannot be fully excluded under applicable law, total aggregate liability for any claim arising from these Terms or your use of Alkebot is limited to the subscription fees you actually paid in the three (3) months immediately before the event giving rise to the claim. This cap applies regardless of the legal theory of the claim (contract, tort, negligence, or otherwise) and even if advised of the possibility of such damages. Nothing in these Terms excludes liability that cannot be excluded under Ghanaian law, such as liability for death or personal injury caused by proven gross negligence or willful misconduct.

9. Indemnification

You agree to indemnify and hold harmless Jose Rodolfo Esapa from any claim, loss, liability, or expense (including reasonable legal fees) arising from: your trading activity and decisions; your breach of these Terms; your violation of any law or of a third party's rights (including your broker's or prop firm's rules); or your misuse of the software, the chat assistant, or your account credentials.

10. Automated chat assistant

Our website may offer an automated chat assistant to answer questions about Alkebot's approach, features, and published performance figures. The assistant only draws on figures we have separately published and verified - it is instructed never to state or imply a guaranteed return, and never to disclose Alkebot's underlying algorithmic parameters or trading rules in detail. Responses from the assistant are provided for general information only, do not constitute financial advice, and are subject to the same risk disclosures, disclaimers, and limitation of liability set out elsewhere in these Terms.

11. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in our service, our pricing, or the law. Where a change is material, we will make reasonable efforts to notify active subscribers (for example, by email, SMS, or an in-dashboard notice) before it takes effect. Continued use of Alkebot after a change takes effect means you accept the updated Terms.

12. Governing law & disputes

These Terms are governed by the laws of the Republic of Ghana, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of Alkebot is subject to the exclusive jurisdiction of the courts of Ghana, unless another dispute-resolution mechanism (for example, arbitration) is agreed between the parties in writing. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force, and the unenforceable provision will be read to achieve, as closely as legally possible, its original intent.
